1. Description of Services

The App leverages Umio Limited’s intellectual property, and artificial intelligence technology provided by OpenAI’s GPT and Dall-E APIs to deliver insight into the lived experience/s of groups of individuals. It also produces narratives, assemblages, ideas, concepts, and images based on the lived experience insight.

2. Use of the App

2.1.   Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App.

2.2.   Acceptable Use

You agree not to:

• Use the App to generate harmful, offensive, or illegal content.
• Reverse-engineer or otherwise tamper with the App or its underlying technology.
• Violate any applicable laws or regulations.

2.3.   Prohibited Uses

You may not submit content into the App that:

• Contains personal or sensitive data of others without their consent.
• Infringes on intellectual property rights.

2.4.   Content Responsibility

You are responsible for the content you submit into the App and any outcomes resulting from the use of the App’s responses.

3. Third-Party Services

The App uses third-party services, including OpenAI’s GPT and Dall-E APIs. Your use of the App is also subject to OpenAI’s Terms of Use . Umio Limited is not responsible for the content or functionality provided by these third-party services.

4. Liability

The App is provided on an ‘as is’ and ‘as available’ basis without any warranty, condition, or representation of any kind, whether express or implied.
Umio Limited does not assume any liability for the accuracy, completeness, or usefulness of information generated by the App, including outputs from the ChatGPT API, which may occasionally produce errors or inaccuracies.

In no event will Umio Limited be liable for any direct, indirect, special, or consequential loss arising from the use, performance, or reliance on information generated by the App.

5. Data Submission, Processing and Use

5.1.   Your Content Rights and Compliance
You represent and warrant that you have the legal right to provide any content you submit into the App and that providing such content does not violate any laws, regulations, or third-party rights.

5.2.   Submission of Personal Data
The App does not require you to submit personal data beyond the information necessary for registration for its use. To protect your privacy, we encourage you to avoid submitting personal data, however, should you do so, you acknowledge and agree that:

• You are solely responsible for the data you choose to provide.
• Submission of personal data is voluntary and is not a condition for using the App’s features.
• Any personal data you submit will be processed in accordance with our Privacy Policy.

5.3.   Content Use

We use the content you submit to the App solely to:

• Generate insights for your use.
• Store a history of your content submissions and outputs for your future access.
  

6. Confidentiality

Umio Limited is committed to keeping your data confidential. The information you input into the App will only be used for the purpose of providing and enhancing your experience with the App, and will not be used for any other purposes. 

7. User Cancellation & Refunds

This User Cancellation & Refund Policy ("Policy") outlines the terms and conditions for refund requests related to the purchase of tokens on our platform. By purchasing tokens, users agree to abide by this Policy.

7.1 Refund Eligibility

7.1.1 Unused Tokens (Full Refund)

Users may request a full refund if they have purchased tokens but have not used any. Refund requests must be submitted within [14/30] days of the purchase date.

7.1.2 Partially Used Tokens (Pro-Rata Refund or Credit)

If a portion of the purchased tokens has been used, users may be eligible for a refund of the unused tokens based on a pro-rata calculation. The refund will be issued minus a [5-10]% processing fee to cover transaction costs. Alternatively, users may opt to receive account credits instead of a cash refund.

7.1.3 Expired Tokens (Non-Refundable)

Tokens have an expiration period of [e.g., 6 months] from the date of purchase. Expired tokens are non-refundable.

7.1.4 Bonus or Promotional Tokens (Non-Refundable)

Any bonus, promotional, or free tokens received as part of a purchase or promotion are not eligible for a refund. Refunds are calculated based on the purchased tokens only.

7.2 Non-Refundable Cases

Refunds will not be issued in the following cases:

• • • Significant Token Usage: If 75% or more of the purchased tokens have been used, a refund will not be granted.

    • Abuse or Fraud: If a user repeatedly purchases and refunds tokens or engages in fraudulent activities.

    • Chargeback Attempts: If a user initiates a chargeback through their payment provider, their account may be suspended.

7.3. Refund Request Process

7.3.1 How to Request a Refund

To request a refund, users must submit a request via [support email or account dashboard] with the following details:

    • Date of purchase

    • Reason for refund request

    • Any supporting documentation (if applicable)

7.3.2 Processing Time

Refunds will be processed within 5-10 business days after approval.

7.3.3 Refund Method

Refunds will be issued to the original payment method used for purchase. If the original payment method is unavailable, an alternative solution (such as account credits) may be provided at the discretion of the company.

7.4. Alternative Options

7.4.1 Token Pause Option

Users who do not require an immediate refund may opt to pause their token expiration instead.

7.4.2 Token Transfers

Instead of requesting a refund, users may transfer their unused tokens to another account upon approval.

7.4.3 Subscription Model Alternative

For users seeking long-term access, a subscription model may be available as an alternative to one-time token purchases.

7.5. Amendments to This Policy

We reserve the right to update or modify this Policy at any time. Any changes will be communicated via our website or email notification.

8. Changes to the Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of the App constitutes your acceptance of the revised Terms.

8. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without prior notice, for any reason, including violation of these Terms.
